Wiggle Room Terms of Service

These terms are an agreement between you, the merchant who installs or uses Wiggle Room: Order Editing ("the app"), and SAB Ventures LLC, doing business as Duskford Digital ("we", "us"). By installing or using the app, you agree to them. Your use of Shopify is also governed by Shopify's own terms.
1. The app
The app lets your customers change their own orders after checkout: the shipping address, item options, quantities, or cancelling the whole order. Customers can only make the changes you allow, within the time window you set, and only before fulfillment starts. Subscription items can't be changed through the app. The app needs a Shopify store that uses Shopify's new customer accounts.
2. Your responsibilities
- Your settings: you choose the settings and are responsible for keeping them in line with your store's policies, such as your refund, cancellation and shipping policies.
- Your customers: you remain responsible for your customers and your orders, including:
- fulfilling orders;
- collecting invoices that customers haven't paid;
- issuing refunds when automatic refunds are off, and reviewing customers' cancellation requests (the app passes them to you instead of cancelling);
- not shipping items added by an edit until the customer has paid the invoice (the app tags these orders "Wiggle Room: payment due");
- handling disputes.
- Laws: you must follow the laws that apply to your store, including consumer protection and privacy laws.
- Customer data: you confirm you have the right to let us process your customers' information to provide the app.
3. Plans, billing and trials
- Plans and prices are shown on the app's Shopify App Store listing. Shopify bills them on your Shopify invoice.
- Trials: paid plans include a free trial as shown there.
- Changing plans: you can upgrade, downgrade or cancel through Shopify at any time.
- Refunds: fees are non-refundable, except where the law or Shopify's billing policies require otherwise.
- Plan limits: each plan has limits, such as edits per month on the free plan, or orders per month on paid plans.
- If you go over a limit, we may ask you to upgrade.
- On the free plan, customer editing pauses until the next month once the limit and a short grace allowance are used.
- Price changes: we will give at least 30 days' notice before changing the price of your current plan.
4. Money and payments
The app does not hold, receive or move funds. Charges, invoices and refunds are created through Shopify, and processed by Shopify and your payment provider.
We show customers amounts based on Shopify's calculations. We are not responsible for payment provider failures, declined refunds, or invoices your customers don't pay. Check refunds and payments in your Shopify admin.
5. Acceptable use
You will not:
- misuse the app, or use it for anything illegal;
- try to break its security or overload it;
- copy, reverse-engineer or resell it.
6. Data and privacy
Our Privacy Policy explains how we handle information. Where we process your customers' personal information, we:
- process it only to provide the app, and on your instructions;
- keep it confidential and protect it with appropriate security;
- use only the service providers listed in the Privacy Policy;
- help you answer your customers' privacy requests;
- delete it when Shopify tells us to, including after you uninstall the app.
7. Availability and changes
We work to keep the app available and working, but we don't guarantee uninterrupted service. We may change or improve features, and we will tell you before any change that significantly reduces what your plan includes.
8. Ownership
We own the app and everything in it. You own your store data. If you send us feedback, we may use it without any obligation to you.
9. Disclaimer
The app is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the extent the law allows:
- we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data;
- our total liability for any claim is limited to the fees you paid us for the app in the 12 months before the claim, or US$100 if you used only the free plan.
11. Indemnity
You will defend and indemnify us against claims arising from your store, your products, your dealings with your customers, or your breach of these terms.
12. Ending the agreement
- You can stop at any time by uninstalling the app.
- We may suspend or end your access if you breach these terms or misuse the app.
Sections 4 and 8 to 13 continue to apply after the agreement ends.
13. Governing law
These terms are governed by the laws of the State of Wyoming, USA. Disputes will be handled by the state or federal courts located in Wyoming.
14. Changes and contact
We may update these terms. If we make a significant change, we will tell you before it takes effect, and continuing to use the app after that means you accept the new terms.
